UKAFG Terms & Conditions

1. Introduction

These Terms & Conditions govern the use of UKAFG, Squawker PC (Windows software), and Squawker Online (web‑based platform). By creating an account or accessing any UKAFG service, you agree to these Terms.

UKAFG provides frequency‑related data, reference material, and software tools for personal hobby use and, where applicable, authorised commercial use under a separate commercial licence.

2. Personal Use Only (Standard Subscriptions)

All standard UKAFG subscriptions including UKAFG database access, Squawker PC, Squawker Online Active Mil and WtrBrowser are licensed strictly for personal, non‑commercial use.

Personal use means:

  • Accessing UKAFG data for individual hobby or research purposes
  • Using UKAFG software on your own devices
  • Viewing, searching, or referencing UKAFG data privately

Personal use does not include:

  • Selling radios programmed with UKAFG data
  • Using UKAFG data within any business, organisation, or commercial activity
  • Incorporating UKAFG data into any paid service, website, or dataset
  • Using UKAFG data to support or enhance a competing product or service
  • Redistributing or exporting UKAFG data in any form

If you intend to use UKAFG data commercially, you must hold a valid UKAFG Commercial Data Licence.

3. Commercial Use & Commercial Data Licence

Commercial use of UKAFG data is not permitted under standard subscriptions.

Commercial use includes:

  • Selling pre‑programmed radios
  • Providing radio programming services
  • Operating a frequency‑data website or database
  • Creating or distributing files containing UKAFG data
  • Using UKAFG data in any paid or revenue‑generating activity

3.1 UKAFG Commercial Data Licence

A Commercial Data Licence allows hobby sellers, radio programmers, and small businesses to legally use UKAFG data when selling pre‑programmed radios.

3.2 What the Commercial Licence Allows

  • Loading UKAFG frequency data into radios intended for resale
  • Using UKAFG data within commercial programming software
  • Advertising radios as “Programmed using UKAFG data under commercial licence”
  • Using UKAFG data for any commercial activity involving radio programming or configuration
  • Use of Squawker PC and Squawker Online for commercial radio programming

3.3 What the Commercial Licence Does Not Allow

  • Reselling or distributing the raw UKAFG database
  • Publishing the database online or sharing it with third parties
  • Transferring the licence to other sellers or businesses
  • Bulk redistribution of UKAFG data in any form
  • Using UKAFG data to build or enhance a competing frequency‑data service

3.4 Licence Term

  • Valid for 12 months from purchase
  • Single‑user licence (one seller / one business)
  • Renews automatically annually

3.5 Attribution Requirement

Commercial licence holders must include the following line in product descriptions or packaging:

“Radio programmed using UKAFG data under commercial licence.”

4. Competitor Access Prohibition

To protect UKAFG’s intellectual property, access is not permitted for individuals or organisations who:

  • Operate a frequency‑data website, database, or commercial radio‑programming service
  • Sell or distribute frequency‑related data commercially
  • Develop products or services that compete with UKAFG or Squawker
  • Intend to benchmark, analyse, or reverse‑engineer UKAFG data or software

Where a conflict of interest exists, UKAFG may:

  • Decline access
  • Terminate accounts
  • Block device IDs
  • Refund unused subscription time
  • Prevent future sign‑ups

This applies regardless of the name, email address, or identity used during registration.

5. Identity Accuracy & Multiple Accounts

Users must provide accurate personal information when creating an account.

The following behaviours may result in immediate account closure:

  • Using multiple identities or aliases
  • Using mismatched billing names
  • Creating multiple accounts to bypass restrictions
  • Providing false or misleading personal details
  • Attempting to conceal commercial activity

UKAFG may request verification where identity inconsistencies are detected.

6. Device ID & Access Control

UKAFG software products use device‑specific identifiers to manage licensing and prevent misuse.

UKAFG may:

  • Block specific device IDs
  • Prevent activation on known devices
  • Restrict access where misuse or conflict of interest is identified

Device‑ID blocking is permanent and applies regardless of future account names or email addresses.

7. Account Termination

UKAFG reserves the right to terminate or restrict access where:

  • Terms & Conditions are breached
  • Commercial use is detected without a valid licence
  • A conflict of interest exists
  • Identity manipulation is identified
  • Attempts are made to circumvent restrictions
  • UKAFG data or software is at risk of misuse

Termination may occur without prior notice.

Unused subscription time will be refunded on a pro‑rated basis where appropriate.

8. Refund Policy (Digital Services)

8.1 No Refunds After Access

Once a user has:

  • Logged into UKAFG
  • Activated Squawker PC
  • Logged into Squawker Online
  • Viewed, downloaded, or used any UKAFG data
  • Activated a licence on any device

No refund will be issued.

Digital data cannot be “returned” once accessed.

8.2 Wrong Subscription Purchased (Squawker PC vs Squawker Online)

If a user purchases the wrong subscription and has not accessed any data, they must contact UKAFG within 48 hours.

UKAFG will:

  • Ask the user to purchase the correct subscription
  • Refund the incorrect subscription once the correct one is purchased
  • Transfer access if appropriate

Once access has occurred on either platform, refunds or transfers are no longer possible.

8.3 Forgetting to Cancel

Subscriptions renew automatically.

If a user forgets to cancel:

  • Refunds will not be issued if the renewal period has begun and access has occurred
  • If no access has occurred after renewal, UKAFG may issue a refund at its discretion

Users are responsible for managing their own subscription renewals.

8.4 Commercial Licence Refunds

Commercial licences follow the same rules:

  • No refunds once data has been accessed
  • No refunds once Squawker PC or Squawker Online has been used
  • No refunds once radios have been programmed using UKAFG data

If a commercial licence was purchased in error and no access has occurred, UKAFG may refund or transfer the licence.

8.5 Abuse Prevention

UKAFG reserves the right to refuse refunds where behaviour indicates:

  • Attempted data extraction
  • Misuse of trial periods
  • Multiple identities
  • Repeated refund requests
  • Attempts to obtain data without payment

Refunds are issued only in accordance with these Terms.

9. Intellectual Property

All UKAFG data, software, content, and reference material are protected intellectual property.

Users may not:

  • Copy, scrape, export, or reproduce UKAFG data
  • Redistribute UKAFG data in any form
  • Use UKAFG data to build or enhance competing datasets
  • Reverse‑engineer UKAFG software or database structures

Any unauthorised use may result in account termination and legal action.

10. Changes to Terms

UKAFG may update these Terms & Conditions at any time. Continued use of the service constitutes acceptance of the latest version.

13. Usage Monitoring & Anti‑Misuse Protection

To protect UKAFG’s intellectual property and ensure compliance with personal‑use licensing, UKAFG monitors certain usage behaviours across its services, including Squawker PC, Squawker Online, Active Mil, and WtrBrowser.

13.1 What UKAFG Monitors

UKAFG may collect and analyse non‑personal usage data, including:

  • Number of exports performed
  • Types of exports performed
  • Locations or regions selected during exports
  • Frequency and volume of exports
  • Patterns indicative of automated extraction or commercial activity

Monitoring is strictly limited to actions performed within UKAFG platforms.

13.2 Purpose of Monitoring

Monitoring is carried out under UKAFG’s legitimate interest in:

  • Preventing unauthorised commercial use
  • Detecting data extraction or redistribution
  • Protecting proprietary frequency data
  • Enforcing licence terms
  • Maintaining service integrity

Monitoring is proportionate, limited to what is necessary, and never used for unrelated purposes.

13.3 Threshold Alerts & Manual Review

Where usage patterns exceed reasonable personal‑use levels, UKAFG may:

  • Flag the account for internal review
  • Request clarification from the user
  • Temporarily restrict access
  • Terminate access where commercial misuse is confirmed

All decisions are subject to human review. No automated decision‑making is used.

13.4 Transparency & Privacy

UKAFG does not collect excessive personal data for monitoring. All usage analytics are processed in accordance with UK GDPR and UKAFG’s Privacy Policy.

Users agree to this monitoring by continuing to use UKAFG services.

13.5 Examples of Misuse Indicators

Indicators of potential commercial use include, but are not limited to:

  • Exporting multiple location‑specific lists in short time periods
  • Repeated exports covering wide geographic areas
  • High‑volume export activity inconsistent with personal hobby use
  • Behaviour suggesting automated scraping or bulk extraction

These indicators do not automatically imply misuse; they simply trigger manual review.
